In-App Competition — Official Rules & Terms

These Terms apply to all Competitions announced within the App Swim app.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE

WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING A SWEEPSTAKES DRAWING

DEPEND UPON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED OR

RESTRICTED BY LAW.

1. About These Terms

These Official Rules and Terms (‘Terms’) govern all Competitions run by App Swim (‘we’, ‘us’, ‘our’). The word

‘Competition’ refers collectively to any skill-based contest, sweepstakes drawing, or combination of both, as

announced within the App Swim app. By entering any Competition, you (‘Participant’) agree to be bound by these

Terms in full. If you do not agree, do not enter.

Each Competition will consist of one or both of the following prize structures, as specified in the Competition

announcement:

• Skill-Based Contest: Winners determined by verified in-app score. No element of chance is involved.

• Sweepstakes Drawing: One or more winners selected at random from a pool of eligible entries. No

purchase is necessary to enter. The App Swim app is free to download and free to play. Reaching any

qualifying score threshold requires only time and gameplay — no payment of any kind.

We reserve the right to cancel, modify, or suspend any Competition at any time due to technical failure, fraud, or

circumstances beyond our control, without liability to Participants.

2. Eligibility

To participate in any Competition, you must:

• Be at least 13 years of age. Participants aged 13–17 must have verifiable parental or legal guardian

consent before entering. By entering, the parent or legal guardian confirms they have read and agreed to

these Terms on the minor’s behalf. A minor may not self-consent.

• Have a valid email address on file with App Swim, linked to your leaderboard profile, through which you can

be contacted if you win.

• Be a natural person. Entries submitted by bots, scripts, groups, or any automated means are void.

• Not be located in a country subject to a US government embargo or designated as supporting terrorism.

• Not appear on any US government prohibited or restricted parties list.

• Not be an employee, contractor, officer, director, or immediate family member of an App Swim employee or

contractor.

We reserve the right to verify eligibility at any time and to disqualify any Participant who does not meet these

requirements or who we believe has violated these Terms.3. Competition Structure & Prize Tiers

Each Competition’s prize amounts, prize tiers, eligible game(s), qualifying thresholds, and Competition period will

be announced within the app. These Terms govern the legal and eligibility framework for all Competitions; the

Competition announcement controls the specific prize amounts, score thresholds, and entry ratios for that event.

Skill-Based Contest Prizes

The top-scoring Participants in a designated game during the Competition period are eligible for ranked prizes as

specified in the Competition announcement (e.g., 1st place, 2nd place). Rankings are determined solely by

verified in-app scores at the close of the Competition period. In the event of a tied score, the Participant who

achieved that score first by timestamp will be ranked higher. All decisions by App Swim regarding scores and

rankings are final.

Sweepstakes Drawing Prizes

Competitions may include one or more Sweepstakes Drawings in which winners are selected at random from a

pool of eligible entries. The method of earning entries, qualifying score thresholds (if any), and points-to-entry ratio

(if any) will be stated in the Competition announcement for each event. Odds of winning any Sweepstakes

Drawing depend upon the total number of eligible entries received during the Competition period.

Each Sweepstakes Drawing within a Competition is independent. Participants who have already won a skill-based

prize or a prior Sweepstakes Drawing within the same Competition are excluded from subsequent drawings in that

same Competition, as specified in the Competition announcement. Winners are selected by random draw from all

eligible entries after the Competition period closes.

Entry Limits

The maximum number of entries any single Participant may accumulate per Sweepstakes Drawing per

Competition period will be stated in the Competition announcement. App Swim reserves the right to cap entries

per Participant to ensure fair participation.

4. How to Enter

The App Swim app is free to download and free to play. No purchase is required to participate in any Competition.

To enter a skill-based contest, play the designated game during the Competition period — your score is recorded

automatically. To enter a Sweepstakes Drawing, earn entries through gameplay as described in the Competition

announcement.

Participants are responsible for ensuring their own device, software, and internet connection are functional. We

are not responsible for entries lost due to technical issues on the Participant’s end, network outages, or app

malfunctions beyond our control.

5. Prizes

5.1 Fulfillment

Prizes are fulfilled as described in the Competition announcement. Gift card prizes are delivered electronically to

the email address linked to the winner’s leaderboard profile within 14 days of winner confirmation. For

higher-value prizes — including physical goods (e.g., electronics) or cash equivalents exceeding $100 —

fulfillment may be via PayPal, Venmo, bank transfer, check, or physical shipment at our discretion.5.2 Conditions

• Prizes are awarded ‘as is’ and are non-transferable. Prizes may not be exchanged for cash, except where

required by law.

• We reserve the right to substitute any prize with one of equal or greater value if the stated prize becomes

unavailable.

• Winners are solely responsible for all applicable federal, state, and local taxes on prizes received.

• For prizes with a combined fair market value of $600 or more received from App Swim in a single calendar

year, winners may be required to provide a valid tax identification number for IRS reporting purposes (Form

1099-MISC).

• Gift cards are subject to the issuing retailer’s own terms and conditions. App Swim is not responsible for

lost, stolen, or expired gift cards after delivery to the winner.

5.3 Large Prize Payouts

For Competitions with a total prize pool exceeding $500, or individual prizes with a fair market value exceeding

$250, winners may be required to sign and return an Affidavit of Eligibility and Liability Release before the prize is

fulfilled. Failure to return required documentation within the specified timeframe will result in forfeiture.

6. Winner Notification & Forfeiture

Winners will be announced within the app and contacted via the email address linked to their App Swim

leaderboard profile. Winners must respond to prize notifications within five (5) calendar days of being contacted. If

a winner does not respond within this window, cannot be reached, is found to be ineligible, or fails to return any

required documentation, that winner forfeits the prize. Up to three alternate winners will be drawn in the same

manner as the original selection. If no eligible winner is confirmed after three alternate selections, the prize will

remain unawarded for that Competition.

App Swim is not responsible for prize notifications that go undelivered due to an invalid, inactive, or unmonitored

email address. It is the Participant’s responsibility to ensure their leaderboard profile email is current and

monitored.

7. Fair Play & Prohibited Conduct

The following will result in immediate disqualification and may result in a permanent ban from future Competitions:

• Use of hacks, cheats, bots, scripts, exploits, or any automated means to achieve scores or generate entries

• Tampering with any Competition mechanic, the app, or any scoring or entry system

• Collusion with other Participants to manipulate rankings or drawing results

• Providing false or misleading information in connection with any entry or prize claim

• Any conduct we determine to be contrary to the spirit of fair competition

We reserve the right to audit scores and entries at any time, including after a winner has been announced. Any

person attempting to defraud App Swim or tamper with the legitimate operation of any Competition may be subject

to civil and/or criminal prosecution. Prizes obtained through prohibited conduct must be returned.

8. DisqualificationWithout limitation, a Participant may be disqualified at App Swim’s sole discretion if the Participant: (i) fails to meet

the eligibility requirements in Section 2; (ii) violates any provision of these Terms; (iii) provides false or misleading

information at any point during the Competition or prize claim process; or (iv) engages in any conduct described in

Section 7.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APP SWIM, ITS OFFICERS, DIRECTORS, EMPLOYEES,

AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,

CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM PARTICIPATION IN ANY COMPETITION,

INCLUDING BUT NOT LIMITED TO: TECHNICAL FAILURES; HARDWARE OR SOFTWARE ERRORS;

NETWORK OR CONNECTIVITY ISSUES; SCORE RECORDING ERRORS; ENTRY PROCESSING ERRORS;

LOST, LATE, OR MISDIRECTED ENTRIES; PRIZE DELIVERY ISSUES; TAX LIABILITY; OR COMPETITION

CANCELLATION OR MODIFICATION. OUR TOTAL LIABILITY TO ANY PARTICIPANT SHALL NOT EXCEED

THE VALUE OF THE PRIZE OFFERED TO THAT PARTICIPANT IN THAT COMPETITION.

10. Release

By entering any Competition, each Participant irrevocably releases, discharges, and holds harmless App Swim

and its officers, directors, employees, agents, and affiliates from and against any and all claims, costs, losses,

expenses, damages, and liabilities arising out of or relating to participation in any Competition or the acceptance,

possession, use, or misuse of any prize.

11. Indemnification

By participating, you agree to indemnify, defend, and hold harmless App Swim and its officers, directors,

employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including

reasonable attorneys’ fees) arising from: (a) your participation in any Competition; (b) your breach of these Terms;

prize claim.

12. Privacy

By entering a Competition, you consent to App Swim collecting and using your name, email address, and

gameplay data to administer the Competition, verify eligibility, fulfill prizes, and announce winners within the app.

We will not sell your personal information. Prize fulfillment may require sharing your information with third-party

payment processors or gift card issuers solely to deliver your prize. Prizes meeting IRS reporting thresholds may

require disclosure to applicable tax authorities.

We do not knowingly collect personal information from children under 13. Participants aged 13–17 require

parental or guardian consent as described in Section 2. Entries from participants under 13 without confirmed

parental consent will be voided.

13. App Store Notice

These Competitions are in no way sponsored, endorsed, administered by, or associated with Apple Inc. or Google

LLC. All Competition questions, prize claims, and disputes must be directed to App Swim at appswim.com — not

to Apple or Google. By participating, you release Apple Inc. and Google LLC from any and all liability related tothis Competition.

14. Winners List

To request a list of confirmed winners for any Competition, send a written request to App Swim via the contact

method listed at appswim.com. Requests must be received within six (6) weeks after the winners for that

Competition have been announced.

15. General Provisions

Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law

principles. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Ohio.

Severability

If any provision is found unlawful or unenforceable, it will be severed and the remaining provisions will remain in

full force and effect.

Entire Agreement

These Terms, together with the specific Competition announcement, constitute the entire agreement between you

and App Swim regarding the Competition. In any conflict, the Competition announcement controls prize amounts,

score thresholds, entry ratios, and game rules; these Terms control all legal and eligibility matters.

Changes to Terms

We may update these Terms at any time. Updates will be posted at appswim.com. Continued participation in any

Competition after updated Terms are posted constitutes acceptance of those Terms.

By entering any Competition, you confirm that you have read, understood, and agree to be bound by these Terms. Participants

aged 13–17 must have a parent or legal guardian agree to these Terms on their behalf before entering.
